TIRANA, March 14 – The Commissioner of Elections, Ilirjan Celibashi, has decided not to accept Enkelejd Alibeaj’s request to register in the May 14 local elections.
In his reasoning, Celibashi has assessed that the request of Berisha’s side does not stand because according to the court’s decision, it is Lulzim Basha who still results as the chairman of the Democratic Party (DP).
Meanwhile, the request of Alibeaj’s group was rejected by the Commissioner as it was not signed by Chairman Lulzim Basha, but by his deputy in this position, which, according to Celibash, is not legal.
“Since from the moment we asked for a completed documentation from the DP to fulfill the conditions to be registered and since there is no other document, I think we are in the same situation as in the last session and I think we should give our judgment on this matter,’ said the chief commissioner.
According to him, the claim that Sali Berisha is the chairman of the Democratic Party is not legally valid and the declaration for registration must be signed by Basha himself, but it was signed by Enkelejd Alibeaj. “The declaration must be signed only by the chairman of the party. The presentation of this document is a condition to be registered as an electoral subject.”
Celibashi noted that Basha’s resignation has not been submitted to the party registration office and the act for the exercise of office by Alibeaj. “In the conditions when the declaration is not according to the law, I think that the DP’s request to be registered has no legal ground and should not be accepted. In conclusion, DP cannot be registered as an electoral subject. This decision-making is based on a legal evaluation of the facts”, said Celibashi. /Argumentum.al
