The third session of the Constitutional Court which is considering the request of Parliament to dismiss President Ilir Meta did not give any concrete result but the judges ruled that the final verdict will be declared within the next 30 days.
“The Constitutional Court ruled that the decision on the case will be clarified within 30 days,” said a brief statement issued by the Court on Monday.
The CC head, Vitore Tusha said at the start of the session that the Assembly had handed over the answers to the questions. “Assembly’s documents have been distributed among the members of the Constitutional Court and a copy has been sent to the President,” she clarified.
The legal adviser of the President of the Republic, Bledar Dervishaj, made the final claims, and according to him, the Assembly, as the legislative body, treats this issue as a blow to the president because he had no case.
Dervishaj demanded the abrogation and declaration as unconstitutional of the decision no. 55 of the Assembly and to conclude that the Assembly has no right to set up a parliamentary inquiry commission in the last 4 months of its functioning.
“The president has not committed any violation, much less serious, of the Constitution. We watched closely where the Assembly arrived for political purposes. It went so far as to manipulate internal administrative acts to overthrow the president’s claims. The procedural violations of the Assembly have been continuous, numerous, repeated. They have no way of leading to a legitimate, valid result. The request of the Assembly has no legitimacy,” said Dervishaj.
He further said that the president’s concerns about the April 25 elections were subsequently proven in international reports. “The president has had a long and confirmed stance, for equality before the law of political forces… The calls of the president of the country in defense of the vote are an increased contribution to the protection of the vote, given the shocking situations that started in Dibra.”
Dervishaj cited as an example the president of Romania who joined the protesters. He stressed that “all the claims of the Assembly for the dismissal of the president are worthy of being based on only one article, that of propaganda, an article that does not exist in the Constitution today.”
In his reaction the leader of the parliamentary group of the ruling Socialist Party (SP), Taulant Balla spoke at the end of the session of the Court and opposed the case of Romania and stated that the president in that country has other powers than those of the president of Albania. According to him, the decision in the case of the clash between the Romanian Parliament and the President in 2007 should be read in this spirit and should be read in full, not in paragraphs.
The SP representative of the Assembly, MP Klotilda Bushka, stated that the President has seriously violated the neutrality he must maintain as a defender of unity. “The Assembly has confirmed that the president has seriously violated the Constitution and we ask the court to dismiss the president,” she said, adding that Meta has seriously violated the obligation to abide by the oath to serve the general interest of the people. / Argumentum.al
