TIRANA, August 30 – The government has submitted for public consultation the proposed changes to one of the main reform laws in justice, the one on the status of judges and prosecutors.
The new legal changes provide that the High Prosecution Council and the Judicial Council must meet immediately for the suspension from office of judges and prosecutors who have not passed the vetting process, but are abusing their duties.
“The draft law aims to stop the magistrate’s abuse of the justice system, when their decision-making has resulted in an obvious violation of the law,” the explanatory statement said. The law approved in 2016 provided that the councils had 3 days to meet from the moment the High Inspector of Justice submitted a request to them for the suspension of magistrates.
Referring to the proposed changes, the councils will have to be convened immediately to consider the request for the suspension of the magistrate, concluding with concrete decision-making on the acceptance or not of the request for suspension presented by the chief inspector of justice.
The Ministry of Justice explained that the legal initiative comes within the framework of the National Consultation for Albania in whose frame citizens give their opinions on various issues.
“One of the questions addressed to the citizens consisted of the issue of whether judges and prosecutors who have not yet passed the vetting process should be suspended from office, if their decision-making results in clear violation of the law,” said the announcement.
